Accessing Zoho TouchPoint
Zoho TouchPoint is a part of Zoho's suite of online collaboration and business productivity applications (hereinafter "Zoho Services"). You will be able to access Zoho TouchPoint by using your common account for all Zoho Services (hereinafter "Zoho Account"). You may also access Zoho TouchPoint through the programming interface provided by Zoho ("API").
Accessing Other Zoho Services
Many Zoho Services are integrated with Zoho TouchPoint. Your Zoho Account will also allow you to access all Zoho Services even if such Zoho Services are not integrated with Zoho TouchPoint. Use of some of these Zoho Services may require acceptance of terms of service specific to such Zoho Services (hereinafter “Service Specific Terms”). You must read, understand and accept the Service Specific Terms before using the corresponding Zoho Service.
NFC Cards
You are required to maintain adequate credits in your Zoho TouchPoint account to purchase NFC Cards. Zoho will ship the NFC Cards to the delivery address specified by you through one of the supported shipment carriers. You are solely responsible for providing complete and accurate shipping and recipient's information necessary for the delivery of the NFC Cards. Zoho is not responsible for any delay, non-delivery, misdelivery or resulting loss or expense arising from, or in connection with, incorrect or incomplete information provided by you.
Upon successful delivery of the NFC Cards, Zoho will send the instructions for activation of the NFC Cards via email and you are responsible to follow the instructions to activate the card. You will not be able to cancel your order after you receive order confirmation email from Zoho. You are required to inspect the NFC Cards upon delivery promptly and you must notify Zoho about any alleged defect, non-conformances, or damages as mentioned in the Shipment and Refund policy. Upon Zoho’s verification of a timely complaint and determination that the NFC Card is defective or otherwise non‑conforming, you may request either for a replacement of the affected NFC Card(s) or reinstatement of the used credits, in accordance with the Shipment and Refund Policy.
Images
The images and designs that are made available for designing the modes through which leads engage with businesses ("Engagement Mode") and landing destination associated with the Engagement Mode ("Landing Destination") are licensed by Zoho from the copyright owners of such images and designs. These images are permitted to be used only on the Engagement Mode and Landing Destinations created using Zoho TouchPoint and are provided as is and as available. You are required to obtain permission from the respective copyright owners before you exploit the images and designs in any other manner.
By using Zoho TouchPoint, you agree that you will not
- publish any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party.
- publish any virus and malicious code which might disrupt, disable, harm, erase memory of, or otherwise impede the operations, or functions of any software, hardware, wireless device, computer or any network of any party.
- publish any material that defames, abuses, harasses, stalks, threatens or otherwise violates privacy and other legal rights of others.
- publish any content that is unlawful, illegal, hateful, promotes racism or promotes discrimination or hatred based on ethnicity.
- publish pornographic and/or obscene content.
- publish any content, that imply or promote support or funding of, or membership in, a terrorist organization.
- impersonate any individual or entity.
- create a load on Zoho’s servers or abuse Zoho’s bandwidth or interfere with.
- violate any applicable local, state, national or international laws.
- promote/distribute or sell illegal and counterfeit products.
- promote or sell pharmaceutical products, gambling services, e-cigarettes, etc.
- publish content that is used for scamming purposes such as pyramid scheme, click fraud or get-rich-quick scheme.
- promote dangerous and illegal activities.
- use Zoho TouchPoint for spamming, phishing or any similar activity.
- publish any pirated content.
- publish any content that is considered as confidential and/or personal information belonging to any person or entity.
- use Zoho TouchPoint for collecting information about others, including e-mail addresses, without their consent.
- interfere with or disrupt the provisioning of Zoho TouchPoint.
- interfere with or disrupt the provisioning of Zoho Touchpoint.
- use Zoho TouchPoint for publishing content that is solely created to manipulate search engine results, search engine ranking and search result placement.
- use Zoho TouchPoint for generating unnatural traffic.
- post affiliate links using Zoho TouchPoint without any original content.
- use Zoho to link or redirect to sites that are involved in any of the prohibited activities listed above.
Your Responsibilities
You are solely responsible for all the data and content that you or your users upload or make available through Zoho TouchPoint, including the information encoded within the Engagement Mode or published on the Landing Destinations ("TouchPoint Content”). You are solely responsible for determining what information to include, how it is presented, and to whom it may be disclosed, and for implementing appropriate controls. Zoho reserves the right to monitor the TouchPoint Content hosted within Zoho domain and may suspend or terminate your access to the Zoho Touchpoint if Zoho in its sole discretion determines that you have violated the Terms.
Zoho shall not be liable for the content, availability, security and compliance of third-party resources that are hosted outside Zoho TouchPoint, including third‑party websites, applications, or messaging endpoints.
Usage limits for Zoho TouchPoint
Zoho may prescribe usage limits based on the subscription plan chosen by you. You must make sure that your usage is within the usage limits prescribed by Zoho in order to avail uninterrupted service. You understand that Zoho may restrict an activity if you reach the usage limit corresponding to such activity.
Terms of use for API
Integration of Zoho TouchPoint with Third Party Applications using APIs provided by Zoho requires technical skill. You understand that errors or defects in the integration may cause loss and corruption of data. You must make sure that you use the services of technically skilled persons for the integration. You agree that Zoho is not liable for any loss and corruption of data caused due to errors or defects in the integration. You must not try to access any functionality that is not exposed in the documentation for the API. You understand and agree that Zoho will not be liable for the consequences of accessing or using any unexposed functionality of the API.
API Usage Limits
Zoho may prescribe usage limits, including limits on the number of calls, number of records per call, bandwidth usage and frequency of calls. You are required to adhere to the usage limits prescribed by Zoho in order to avail uninterrupted service. You understand that Zoho may restrict an activity if you reach the usage limit corresponding to such activity and that an API call may either fail or be partially executed if the usage limits are reached before or during an API call.
API Deprecation
Zoho, in its discretion, may cease providing the current version of the API either as a result of discontinuation of the API or upgradation of the API to a newer version. In both cases, the current version of the API will stand deprecated and become the deprecated version of the API (hereinafter "Deprecated Version"). When Zoho decides to deprecate the current version of the API, You will be informed about such deprecation through a service announcement. For a period of six months following announcement of deprecation (hereinafter the "Deprecation Period"), Zoho will use commercially reasonable efforts to support the Deprecated Version. You understand that Zoho is not obliged to provide the features of the newer version in the Deprecated Version. Zoho in its discretion may cease supporting the Deprecated Version during the Deprecation Period if i) Zoho is required to do so by law or ii) You have breached any provision of these Terms or the General Terms of Service or iii) Zoho determines that supporting the API is likely to result in a security risk to Zoho.
Modification of Terms of Use
Zoho reserves the right to modify Zoho TouchPoint Terms of Use. Modifications to the Terms of Use are effective upon your use of Zoho TouchPoint subsequent to publication of such modification.
