Zoho Domains - TLD Specific Terms

The following TLD Specific Terms ("Terms") apply to the Registered Domain Names registered by you with the Registries. These Terms along with the policies of the Registries form an integral part of the Domain Name Registration Agreement.

1. Radix

The following terms shall be applicable to TLDs registered with Radix.

(1) Radix reserves the absolute right to deny, cancel, delete or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (i) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs), (ii) to correct mistakes made by Radix or any registrar in connection with a domain name registration, (iii) for the non-payment of fees to Radix, (iv) to protect the integrity and stability of the registry system; (v) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (vi) to avoid any liability, civil or criminal, on the part of Radix, as well as its affiliates, subsidiaries, officers, directors, and employees.

(2) Registrant shall comply with all applicable laws including those that relate to privacy, data collection, consumer protection (including in relation to misleading and deceptive conduct) and applicable consumer laws in respect of fair lending, debt collection, organic farming (if applicable), disclosure of data and financial regulations.

(3) Registrant acknowledges and agrees that registrants who collect and maintain sensitive health and financial data must implement reasonable and appropriate security measures commensurate with the offering of those services, as defined by applicable law.

(4) Registrant warrants that no domain name registration within any Included TLD shall be used to distribute malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or other similar activity and providing consequences for such activities including suspension of the domain name.

(5) Registrant agrees to comply with all operational standards, procedures, practices and policies for the Included TLD including the Radix Acceptable Use and Anti-Abuse Policy (“AUP”) and all other applicable policies which will be available on the Radix website (www.radixregistry.com), established from time to time by Radix in a non-arbitrary manner and applicable to all registrars, including affiliates of Radix, and consistent with ICANN’s standards policies, procedures, and practices and Radix’s Registry Agreement with ICANN for the Included TLD. Additional or revised Radix operational standards, policies, procedures, and practices for the Included TLD shall be effective upon ninety (90) days notice by Radix to Zoho unless mandated by ICANN with a shorter notice period.

(6) Registrar consents to the use, copying, distribution, publication, modification and other processing of Registrant's Personal Data by Radix and its designees and agents, including data escrow requirements as specified in the agreement with Zoho or as specified by ICANN from time to time for new gTLDs.

(7) Registrant expressly agree that registration and renewal fees for some domain names in an Included TLD are variable and shall differ from registration and renewal fees for other domain names within that Included TLD. This includes but is not limited to non-standard pricing for Premium Domain Name registration and renewal fees, which differs from the pricing of Standard Domain Names.

(8) Registrant agrees that registration, renewal and transfers fees for each Included TLD are variable.

(9) Registrant agrees and acknowledges to be bound by the terms and conditions of the initial launch of the Included TLD, including without limitation the sunrise period and the land-rush period, the procedure and process for compliance with ICANN’s rights protection mechanisms including the Trademark Clearing House requirements and any Sunrise Dispute Resolution Policy, and further to acknowledge that Radix and/or its service providers have no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the sunrise period or the land-rush period, including, without limitation: (a) the ability or inability of a registrant to obtain a domain name during these periods, and (b) the results of any dispute over a sunrise registration.

(10) Registrant agrees to indemnify, defend and hold harmless Radix, Radix’s Registry Service Provider and its subcontractors, and its and their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating in any way, for any reason whatsoever, to the Registrant's domain name registration, any breach of the Registration Agreement with Registrar and any use of the domain name. The Registration Agreement shall further require that this indemnification obligation survive the termination or expiration of the Registration Agreement.

2. Verisign

The following terms shall be applicable to TLDs registered with Verisign.

(a) Registrar certifies to the best of its knowledge that the Registered Domain Name is registered in compliance with the eligibility requirements of the TLDs.

(b) Registrant acknowledges and agrees that Verisign reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, as it deems necessary, in its unlimited and sole discretion: (i) to comply with specifications adopted by any industry group generally recognized as authoritative with respect to the Internet (e.g., RFCs); (ii) to correct mistakes made by Verisign or any Registrar in connection with a domain name registration; or (iii) for the non-payment of fees to Verisign.

(c) Registrant agrees to indemnify, defend and hold harmless Verisign and its subcontractors, and its and their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, liabilities, costs and expenses, including reasonable legal fees and expenses arising out of or relating to, for any reason whatsoever, the Registrant's domain name registration.

3. GMO Registry

(a) Registrant shall comply with all applicable laws and government regulations.

(b) Registrant shall comply with all ICANN standards, policies, procedures, and practices for which GMO Registry has monitoring responsibility in accordance with the Registry Agreement or other arrangement with ICANN.

(c) Registrant shall comply with all operational standards, policies, procedures, and practices for the Registry System established from time to time by GMO Registry.

(d) Registrant agrees to indemnify, defend and hold harmless the GMO Registry, including its directors, officers, employees, subcontractors and agents, to the maximum extent required by law, from and against any claims, damages, liabilities, costs and expenses arising out of or relating to any application and/or request for the registration of a domain name made hereunder, the registration of a domain name and/or the use of a Registered Domain Name.

(e) Registrant shall update or correct registration information during the registration term of the Registered Domain Name.

(f) Registrant shall acknowledge and accept that the GMO Registry may make use of such Registrant’s Personal Data, which use includes the processing, copying, publishing, modifying and making available through the WHOIS Service, of any such data, and authorize its subcontractors and agents to do the same, in accordance and compliance with relevant applicable data protection and privacy legislation, and for the sole purposes of allowing the Registrar to render domain name registration services.

(g) Registrant shall adhere to dispute resolution proceedings under the UDRP and URS System concerning the Registered Domain Names, where applicable.

(h) Registrant shall agree to be bound by the terms and conditions of the initial launch phases of the TLD, the Sunrise period, and the corresponding dispute resolution processes, as set out in the TLD Policies, and shall acknowledge that Registry has no liability of any kind for any loss or liability resulting from the proceedings and processes relating to the Sunrise period, including, but not limited to: (a) the ability or inability of a registrant to obtain a domain name registration during this period, and (b) the results of any dispute procedures.

(i) Registrant agrees to higher renewal pricing for a domain name where, at the time of the initial registration of the Registered Domain Name, clear and conspicuous disclosure of such renewal pricing was made.

(j) Registrant shall be prohibited from using a Registered Domain Name for distributing malware, abusively operating botnets, phishing, piracy, trademark or copyright infringement, fraudulent or deceptive practices, counterfeiting or otherwise engaging in activity contrary to applicable law.

(k) Registrant shall acknowledge and agree that GMO Registry reserves the right to deny, cancel or transfer any registration or transaction, or place any domain name(s) on registry lock, hold or similar status, that it deems necessary, in its discretion: (i) to protect the integrity and stability of the registry; (ii) to comply with any applicable laws, government rules or requirements, requests of law enforcement, or any dispute resolution process; (iii) to avoid any liability, civil or criminal, on the part of Registry, as well as its affiliates, subsidiaries, officers, directors, and employees; (iv) per the terms of the Domain Name Registration agreement; (v) in the event of an occurrence of any of the activities listed in section 3 (j) above; or (vi) to correct mistakes made by Registry or any Registrar in connection with a domain name registration. GMO Registry also reserves the right to place upon registry lock, hold or similar status a domain name during resolution of a dispute.

4. CentralNic

The following terms shall be applicable to TLDs registered with registries for which CentralNic is a registry service provider.

(a) Registrant acknowledges having read and understood and agrees to be bound by the terms and conditions of the CentralNic Dispute Resolution Policy, available at http://www.centralnic.com/support/dispute.

(b) Registrant agrees to indemnify, defend and hold harmless the CentralNic, and its directors, officers, employees and agents from and against any and all claims, damages, liabilities, costs and expenses, including legal fees and expenses, arising out of or relating to the Registrant's domain name registration.

(c) Registrant consents to the use, copying, distribution, publication, modification, and other processing of Registrant's Personal Data by Central Nic and its designees and agents in a manner consistent with the purposes specified pursuant in providing the domain name and maintaining the Whois record.

5. .IN Registry

The following terms shall be applicable to TLDs registered with .IN Registry

(a) The Registrant shall provide to Registrar accurate and reliable contact details and promptly correct and update them during the term of the Registered Name, including: the full name, postal address, email address, voice telephone number, and fax number if available of the Registrant; name of authorized person for contact purposes, in case of a Registrant that is an organization, association, or corporation. The email address submitted in the contact information will be that of the Registrant only. This correct information should be available in WHOIS of .IN Registry, and it is the duty of the Registrant to check this information from time to time and make sure that it is up-to-date. A Registrant's willful or grossly negligent provision of inaccurate, false or unreliable information, and in the event the registrant willfully or grossly neglects to promptly update information provided to Registrar shall constitute a material breach of the Domain Name Registration Agreement with the Registrar and be a basis for cancellation of the Registered Name, and any other action under the relevant laws of India.

(b) The Registrant undertakes that it shall not register a domain name which is contrary to public policy and that the Content of the website shall not be in violation of any Indian Laws.

(c) The Registrant shall use the domain name in such a way that it does not violate any third-party rights, applicable laws or regulations, including discrimination on the basis of race, language, sex or religion and the Registrant further warrants that it shall not register or use the domain name in bad faith or for any unlawful purpose.

(d) .IN Registry considers illegal or fraudulent actions, spamming, using email in denial-of-service attacks, Phishing, Pharming, Botnet command and control, Distribution of pornography, Illegal Access to other computer and networks etc. as abusive use of domain name. Registry can suspend the Registered name in such cases and initiate action accordingly. Further, Fast Flux hosting may be used only with prior permission of .IN Registry.

(e) Payment of any fees due, for which the Registrant is solely liable, must be made with the Registry via Registrar. The Registry is not responsible for any failure on the part of the Registrar in this respect, including where such failure results in non-registration or cancellation of the Domain Name.

(f) The Registrant shall be liable for any costs, expenses or damages incurred by the Registry for any breach of these Terms and Conditions. Furthermore, the Registrant shall hold the Registry harmless from claims filed or disputes initiated by third parties to this terms, and shall compensate the Registry for any costs or expenses incurred or damages it may suffer through third parties taking action against it on the grounds that the application for the registration or the use of the Domain Name by the Registrant infringes the rights of said third parties.

(g) The Registry is under no obligation to inform the Registrant in advance, when the Term of a domain name registration is about to expire. Registrant is fully responsible for ensuring that renewal is done well in time.

(h) The .IN Registry shall be entitled to immediately suspend or cancel the Domain Name Registration, when the Registrant is in breach of the Terms and Conditions as enshrined here.

(i) A Registrant is required to submit to mandatory arbitration proceedings in the event a complainant files a complaint with .IN Registry, against a registrant on the basis of unlawful registration of a domain name. The arbitration proceedings shall be conducted by one of .IN Registry Empanelled Arbitrators, in accordance with Dispute Resolution Policy and Procedure and Arbitration & Conciliation Act, 1996.

(j) The .IN Registry reserves the right to instruct its Registry Services Provider to deny, cancel, transfer or otherwise make unavailable any registration that it deems necessary or place any domain name(s) on registry lock and/or put a domain name on hold in its discretion: (i) to protect the integrity and stability of .IN Registry; (ii) to comply with any applicable laws, Indian government rules or requirements, requests of law enforcement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil or criminal, on the part of the .IN Registry, as well as its affiliates, subsidiaries, officers, directors, representatives and employees; (iv) for violations of this terms; or (v) to correct mistakes made by the Registry or any Registrar in connection with a domain name registration. The Registry also reserves the right to freeze a domain name during resolution of a dispute pending before arbitrator(s) appointed under Registryís Domain Name Dispute Resolution Policy and/or a court of competent jurisdiction.
